1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and CheckViral, operated by Ivan Bilous ("Service", "we", "us", or "our"). By accessing or using CheckViral, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any updates to these Terms constitutes your acceptance of the revised Terms.

2. Description of Service

CheckViral is a short-form video analysis platform that provides users with insights about video and slideshow content. The Service is available to individuals and businesses worldwide. All users must comply with these Terms as a condition of use.

3. User Accounts

To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Promptly notifying us of any unauthorized use of your account

4. Subscription Plans & Billing

CheckViral offers paid subscription plans with credit-based usage. By subscribing, you authorise us (through Paddle as payment processor) to charge the applicable fees to your designated payment method.

Subscription fees are billed in advance on a recurring basis. You are responsible for all charges associated with your account. Paddle acts as the Merchant of Record for all transactions – your payment details are processed and held by Paddle in accordance with their terms and privacy policy.

5. Cancellation & Refunds

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of the current billing period; you will retain access to the Service until that date.

Refunds are governed by our Refund Policy. Approved refunds are processed by Paddle and may take 5–10 business days to appear on your statement.

6. Data Collection and Privacy

We are committed to protecting your personal data. The collection, use, and storage of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We collect personal information including first name and email. All data is stored on servers located in the United States. We do not sell or directly share your personal data with third parties, except as described in our Privacy Policy.

7. Account Suspension & Termination

We reserve the right to suspend or terminate your account at any time, for any reason, including but not limited to violation of these Terms. We will endeavour to provide reasonable notice where practicable, except where immediate action is required to protect the Service, other users, or third parties.

8. Disclaimers

We strive to provide accurate and meaningful short-form video analysis, but the quality of our output depends on the source content being analyzed. We are not responsible for decisions made based on analysis results.

9. Limitation of Liability

CheckViral is provided "as is" without warranties of any kind. We are not responsible for any indirect losses that result from your use of the Service. Our liability is limited to the extent permitted by law.

10. Change to Terms

CheckViral reserves the right to modify these Terms at any time. Changes will be effective upon posting. Continued use of the Service constitutes acceptance of the revised Terms.
